{"id":6980,"date":"2022-07-10T15:57:59","date_gmt":"2022-07-10T15:57:59","guid":{"rendered":"https:\/\/rosenlegal.com\/?post_type=case&#038;p=6976"},"modified":"2022-07-11T15:23:30","modified_gmt":"2022-07-11T15:23:30","slug":"outset-medical-inc","status":"publish","type":"case","link":"https:\/\/rosenlegal.com\/zh\/case\/outset-medical-inc\/","title":{"rendered":"Outset Medical, Inc."},"content":{"rendered":"<p>According to the lawsuit, defendants throughout the Class Period made false and\/or misleading statements and\/or failed to disclose that:<\/p>\n<ul>\n<li><span style=\"font-size: 16px\">defendants had \u201ccontinuously made improvements and updates to Tablo over time since its original clearance\u201d that required an additional 510(k) application;<\/span><\/li>\n<li><span style=\"font-size: 16px\">as a result, the Company could not conduct a human factors study on a cleared device in accordance with FDA protocols;<\/span><\/li>\n<li><span style=\"font-size: 16px\">the Company\u2019s inability to conduct the human factors study subjected the Company to the likelihood of the FDA imposing a \u201cshipment hold\u201d and marketing suspension, leaving the Company unable to sell Tablo for home use; and<\/span><\/li>\n<li><span style=\"font-size: 16px\">as a result, defendants\u2019 positive statements about the Company\u2019s business, operations, and prospects were materially false and misleading and\/or lacked a reasonable basis at all relevant times.<\/span><\/li>\n<\/ul>\n<p>No Class Has Been Certified.
