{"id":6371,"date":"2022-05-23T14:17:09","date_gmt":"2022-05-23T14:17:09","guid":{"rendered":"https:\/\/rosenlegal.com\/?post_type=case&#038;p=6371"},"modified":"2022-05-23T14:17:09","modified_gmt":"2022-05-23T14:17:09","slug":"enservco-corporation","status":"publish","type":"case","link":"https:\/\/rosenlegal.com\/case\/enservco-corporation\/","title":{"rendered":"Enservco Corporation"},"content":{"rendered":"<p>According to the lawsuit, defendants throughout the Class Period made false and\/or misleading statements and\/or failed to disclose that:<\/p>\n<ul>\n<li><span style=\"font-size: 16px\">Enservco had defective disclosure controls and procedures and internal control over financial reporting;<\/span><\/li>\n<li><span style=\"font-size: 16px\">as a result, there were errors in Enservco\u2019s financial statements relating to, inter alia, its transactions with Cross River Partners and accounting for Employee Retention Credits (\u201cERCs\u201d);<\/span><\/li>\n<li><span style=\"font-size: 16px\">accordingly, the Company would need to restate certain of its financial statements and delay the filing of its 2021 annual report with the U.S. Securities and Exchange Commission (\u201cSEC\u201d);<\/span><\/li>\n<li><span style=\"font-size: 16px\">the Company downplayed the true scope and severity of its financial reporting issues;<\/span><\/li>\n<li><span style=\"font-size: 16px\"> accordingly, the Company could not file its delayed 2021 annual report with the SEC within its initially represented timeline; and<\/span><\/li>\n<li><span style=\"font-size: 16px\">as a result, the Company\u2019s public statements were materially false and misleading at all relevant times.<\/span><\/li>\n<\/ul>\n<p>No Class Has Been Certified.
