According to the complaint, defendants made false and/or misleading statements and/or failed to disclose that:
- Freeport-McMoRan did not adequately ensure safety at the Grasberg Block Cave mine in Indonesia;
- the lack of proper safety precautions constituted a heightened risk that could foreseeable lead to the death of Freeport-McMoRan’s workers;
- this constituted an undisclosed heightened risk of regulatory, litigation, and reputational risk; and
- as a result, defendants’ statements about Freeport-McMoRan’s business, operations, and prospects were materially false and misleading and/or lacked a reasonable basis as all relevant times.
