According to the lawsuit, defendants throughout the Class Period made false and/or misleading statements and/or failed to disclose that:
- Energy Transfer had inadequate internal controls and procedures to prevent contractors from engaging in illegal conduct with regards to drilling activities, and/or failed to properly mitigate known issues related to such controls and procedures;
- Energy Transfer, through its subsidiary, hired third-party contractors to conduct horizontal directional drilling activities (“HDDs”) for the Rover Pipeline Project, whose conduct of adding illegal additives in the drilling mud caused severe pollution near the Tuscarawas River in Ohio when the April 13, 2017 release of drilling mud near the Tuscarawas River (the “April 13 Release”) took place; and (3) Energy Transfer continually downplayed its potential civil liabilities when Federal Energy Regulatory Commission (“FERC”) was actively investigating Energy Transfer’s wrongdoing related to the April 13 Release and consistently provided it with updated information about FERC’s findings on this matter.
No Class Has Been Certified. Until a class is certified, you are not represented by counsel unless you retain one. You may select counsel of your choice. You may also remain an absent class member and do nothing at this point. An investor’s ability to share in any potential future recovery is not dependent upon serving as lead plaintiff.
